# §69h. Guaranty

- (a) **Avoidance of liability; requirements—** No [person](/usc/15/69.md?p=a) shall be guilty under [section 69a of this title](/usc/15/69a.md) if he establishes a guaranty received in good faith signed by and containing the name and address of the [person](/usc/15/69.md?p=a) residing in the [United States](/usc/15/69.md?p=k) by whom the [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b) guaranteed was manufactured or from whom it was received, that said [fur product](/usc/15/69.md?p=d) is not misbranded or that said [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b) is not falsely advertised or invoiced under the provisions of this subchapter. Such guaranty shall be either (1) a separate guaranty specifically designating the [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b) guaranteed, in which case it may be on the [invoice](/usc/15/69.md?p=f) or other paper relating to such [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b); or (2) a continuing guaranty filed with the [Commission](/usc/15/69.md?p=g) applicable to any [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b) handled by a guarantor, in such form as the [Commission](/usc/15/69.md?p=g) by rules and regulations may prescribe.
- (b) **Furnishing false guaranty—** It shall be unlawful for any [person](/usc/15/69.md?p=a) to furnish, with respect to any [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b), a false guaranty (except a [person](/usc/15/69.md?p=a) relying upon a guaranty to the same effect received in good faith signed by and containing the name and address of the [person](/usc/15/69.md?p=a) residing in the [United States](/usc/15/69.md?p=k) by whom the [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b) guaranteed was manufactured or from whom it was received) with reason to believe the [fur product](/usc/15/69.md?p=d) or [fur](/usc/15/69.md?p=b) falsely guaranteed may be introduced, sold, transported, or distributed in [commerce](/usc/15/69.md?p=j), and any [person](/usc/15/69.md?p=a) who violates the provisions of this subsection is guilty of an unfair method of competition, and an unfair or deceptive act or practice, in [commerce](/usc/15/69.md?p=j) within the meaning of the [Federal Trade Commission Act](/usc/15/69.md?p=h) [[15 U.S.C. 41](/usc/15/41.md) et seq.].
