# §3060. State delegation; cooperation

- (a) **State delegation—**
  - (1) **In general—** The [Authority](/usc/15/3051.md?p=1) may enter into an [agreement](/usc/15/7a.md?p=2) with a [State racing commission](/usc/15/3051.md?p=18) to implement, within the jurisdiction of the [State racing commission](/usc/15/3051.md?p=18), a component of the [racetrack safety program](/usc/15/3051.md?p=16) or, with the concurrence of the anti-doping and medication control enforcement agency under [section 3054(e) of this title](/usc/15/3054.md?p=e), a component of the [horseracing anti-doping and medication control program](/usc/15/3051.md?p=9), if the [Authority](/usc/15/3051.md?p=1) determines that the [State racing commission](/usc/15/3051.md?p=18) has the ability to implement such component in accordance with the rules, standards, and requirements established by the [Authority](/usc/15/3051.md?p=1).
  - (2) **Implementation by State racing commission—** A [State racing commission](/usc/15/3051.md?p=18) or other appropriate regulatory body of a [State](/usc/15/15g.md?p=2) may not implement such a component in a manner less restrictive than the rule, standard, or requirement established by the [Authority](/usc/15/3051.md?p=1).
- (b) **Cooperation—** To avoid duplication of functions, facilities, and personnel, and to attain closer coordination and greater effectiveness and economy in [administration](/usc/15/636e.md?p=1) of Federal and [State](/usc/15/15g.md?p=2) law, where conduct by any [person](/usc/15/7a.md?p=6) subject to the horseracing medication control program or the [racetrack safety program](/usc/15/3051.md?p=16) may involve both a medication control or [racetrack](/usc/15/3051.md?p=15) safety rule violation and violation of Federal or [State](/usc/15/15g.md?p=2) law, the [Authority](/usc/15/3051.md?p=1) and Federal or [State](/usc/15/15g.md?p=2) law enforcement [authorities](/usc/15/3051.md?p=1) shall cooperate and share information.
