# §2667. Radon in schools

- (a) **Study of radon in schools—**
  - (1) **Authority—** The [Administrator](/usc/15/2642.md?p=2) shall conduct a study for the purpose of determining the extent of [radon](/usc/15/2662.md?p=3) contamination in the Nation’s [school buildings](/usc/15/2642.md?p=13).
  - (2) **List of high probability areas—** In carrying out such study, the [Administrator](/usc/15/2642.md?p=2) shall identify and compile a list of areas within the [United States](/usc/15/2602.md?p=17) which the [Administrator](/usc/15/2642.md?p=2) determines have a high probability of including [schools](/usc/15/2642.md?p=12) which have elevated levels of [radon](/usc/15/2662.md?p=3).
  - (3) **Basis of list—** In compiling such list, the [Administrator](/usc/15/2642.md?p=2) shall make such determinations on the basis of, among other things, each of the following:
    - (A) Geological data.
    - (B) Data on high [radon](/usc/15/2662.md?p=3) levels in homes and other structures nearby any such [school](/usc/15/2642.md?p=12).
    - (C) Physical characteristics of the [school buildings](/usc/15/2642.md?p=13).
  - (4) **Survey—** In conducting such study the [Administrator](/usc/15/2642.md?p=2) shall design a survey which when completed allows Congress to characterize the extent of [radon](/usc/15/2662.md?p=3) contamination in [schools](/usc/15/2642.md?p=12) in each [State](/usc/15/2642.md?p=14). The survey shall include testing from a representative sample of [schools](/usc/15/2642.md?p=12) in each high-risk area identified in [paragraph (1)](#a-1) and shall include additional testing, to the extent resources are available for such testing. The survey also shall include any reliable testing data supplied by [States](/usc/15/2642.md?p=14), [schools](/usc/15/2642.md?p=12), or other parties.
  - (5) **Assistance—**
    - (A) The [Administrator](/usc/15/2642.md?p=2) shall make available to the appropriate agency of each [State](/usc/15/2642.md?p=14), as designated by the Governor of such [State](/usc/15/2642.md?p=14), a list of high risk areas within each [State](/usc/15/2642.md?p=14), including a delineation of such areas and any other data available to the [Administrator](/usc/15/2642.md?p=2) for [schools](/usc/15/2642.md?p=12) in that [State](/usc/15/2642.md?p=14). To assist such agencies, the [Administrator](/usc/15/2642.md?p=2) also shall provide [guidance](/usc/15/2602.md?p=7) and data detailing the risks associated with high [radon](/usc/15/2662.md?p=3) levels, technical [guidance](/usc/15/2602.md?p=7) and related information concerning testing for [radon](/usc/15/2662.md?p=3) within [schools](/usc/15/2642.md?p=12), and methods of reducing [radon](/usc/15/2662.md?p=3) levels.
    - (B) In addition to the assistance authorized by [subparagraph (A)](#a-5-A), the [Administrator](/usc/15/2642.md?p=2) is authorized to make available to the appropriate agency of each [State](/usc/15/2642.md?p=14), as designated by the Governor of such [State](/usc/15/2642.md?p=14), [devices](/usc/15/55.md?p=d) suitable for use by such agencies in conducting tests for [radon](/usc/15/2662.md?p=3) within the [schools](/usc/15/2642.md?p=12) under the jurisdiction of any such [State](/usc/15/2642.md?p=14) agency. The [Administrator](/usc/15/2642.md?p=2) is authorized to make available to such agencies the use of laboratories of the Environmental Protection Agency, or to recommend laboratories, to evaluate any such [devices](/usc/15/55.md?p=d) for the presence of [radon](/usc/15/2662.md?p=3) levels.
  - (6) **Diagnostic and remedial efforts—** The [Administrator](/usc/15/2642.md?p=2) is authorized to select, from high-risk areas identified in [paragraph (2)](#a-2), [school buildings](/usc/15/2642.md?p=13) for purposes of enabling the [Administrator](/usc/15/2642.md?p=2) to undertake diagnostic and remedial efforts to reduce the levels of [radon](/usc/15/2662.md?p=3) in such [school buildings](/usc/15/2642.md?p=13). Such diagnostic and remedial efforts shall be carried out with a view to developing technology and expertise for the purpose of making such technology and expertise available to any [local educational agency](/usc/15/2642.md?p=7) and the several [States](/usc/15/2642.md?p=14).
  - (7) **Status report—** On or before October 1, 1989, the [Administrator](/usc/15/2642.md?p=2) shall submit to the Congress a status report with respect to action taken by the [Administrator](/usc/15/2642.md?p=2) in conducting the study required by this section, including the results of the [Administrator](/usc/15/2642.md?p=2)’s diagnostic and remedial work. On or before October 1, 1989, the [Administrator](/usc/15/2642.md?p=2) shall submit a final report setting forth the results of the study conducted pursuant to this section, including the results of the [Administrator](/usc/15/2642.md?p=2)’s diagnostic and remedial work, and the recommendations of the [Administrator](/usc/15/2642.md?p=2).
- (b) **Authorization—** For the purpose of carrying out the provisions of [paragraph (6)](#a-6) of subsection (a), there are authorized to be appropriated such sums, not to exceed $500,000, as may be necessary. For the purpose of carrying out the provisions of this section other than such [paragraph (6)](#a-6), there are authorized to be appropriated such sums, not to exceed $1,000,000, as may be necessary.
