# §2308. Implied warranties

- (a) **Restrictions on disclaimers or modifications—** No [supplier](/usc/15/2301.md?p=4) may disclaim or modify (except as provided in [subsection (b)](#b)) any [implied warranty](/usc/15/2301.md?p=7) to a [consumer](/usc/15/2301.md?p=3) with respect to such [consumer product](/usc/15/2301.md?p=1) if (1) such [supplier](/usc/15/2301.md?p=4) makes any [written warranty](/usc/15/2301.md?p=6) to the [consumer](/usc/15/2301.md?p=3) with respect to such [consumer Product](/usc/15/2301.md?p=1), or (2) at the time of sale, or within 90 days thereafter, such [supplier](/usc/15/2301.md?p=4) enters into a [service contract](/usc/15/2301.md?p=8) with the [consumer](/usc/15/2301.md?p=3) which applies to such [consumer product](/usc/15/2301.md?p=1).
- (b) **Limitation on duration—** For purposes of this chapter (other than [section 2304(a)(2) of this title](/usc/15/2304.md?p=a-2)), [implied warranties](/usc/15/2301.md?p=7) may be limited in duration to the duration of a [written warranty](/usc/15/2301.md?p=6) of reasonable duration, if such limitation is conscionable and is set forth in clear and unmistakable language and prominently displayed on the face of the warranty.
- (c) **Effectiveness of disclaimers, modifications, or limitations—** A disclaimer, modification, or limitation made in violation of this section shall be ineffective for purposes of this chapter and [State law](/usc/15/2301.md?p=15).
