# §5910. Treatment of payment stablecoin issuers in insolvency proceedings


Subject to [section 507(e) of title 11](/usc/11/507.md), as added by subsection (d), in any insolvency proceeding of a [permitted payment stablecoin issuer](/usc/12/5901.md?p=23) under Federal or [State](/usc/12/5901.md?p=28) law, including any proceeding under that title and any insolvency proceeding administered by a [State payment stablecoin regulator](/usc/12/5901.md?p=30) with respect to a [permitted payment stablecoin issuer](/usc/12/5901.md?p=23)—

- (1) the claim of a [person](/usc/12/5901.md?p=24) holding [payment stablecoins](/usc/12/5901.md?p=22) issued by the [permitted payment stablecoin issuer](/usc/12/5901.md?p=23) shall have priority, on a ratable basis with the claims of other [persons](/usc/12/5901.md?p=24) holding such [payment stablecoins](/usc/12/5901.md?p=22), over the claims of the [permitted payment stablecoin issuer](/usc/12/5901.md?p=23) and any other holder of claims against the [permitted payment stablecoin issuer](/usc/12/5901.md?p=23), with respect to required [payment stablecoin](/usc/12/5901.md?p=22) reserves;
- (2) notwithstanding any other provision of law, including the definition of “claim” under [section 101(5) of title 11](/usc/11/101.md?p=5), any [person](/usc/12/5901.md?p=24) holding a [payment stablecoin](/usc/12/5901.md?p=22) issued by the [permitted payment stablecoin issuer](/usc/12/5901.md?p=23) shall be deemed to hold a claim; and
- (3) the priority under [paragraph (1)](#1) shall not apply to claims other than those arising directly from the holding of [payment stablecoins](/usc/12/5901.md?p=22).
