# §5434. Funds transferred


The [funds](/usc/12/5381.md?p=a-12) that, on the day before the [transfer date](/usc/12/5301.md?p=17), the [Director](/usc/12/5341.md?p=1) of the [Office](/usc/12/5341.md?p=1) of Thrift Supervision (in consultation with the Comptroller of the Currency, the [Chairperson](/usc/12/5311.md?p=a-2) of the [Corporation](/usc/12/5301.md?p=7), and the Chairman of the [Board of Governors](/usc/12/5301.md?p=3)) determines are not necessary to dispose of the affairs of the [Office](/usc/12/5341.md?p=1) of Thrift Supervision under [section 5435 of this title](/usc/12/5435.md) and are available to the [Office](/usc/12/5341.md?p=1) of Thrift Supervision to pay the expenses of the [Office](/usc/12/5341.md?p=1) of Thrift Supervision—

- (1) relating to the functions of the [Office](/usc/12/5341.md?p=1) of Thrift Supervision transferred under [section 5412(b)(2)(B) of this title](/usc/12/5412.md?p=b-2-B), shall be transferred to the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency on the [transfer date](/usc/12/5301.md?p=17);
- (2) relating to the functions of the [Office](/usc/12/5341.md?p=1) of Thrift Supervision transferred under [section 5412(b)(2)(C) of this title](/usc/12/5412.md?p=b-2-C), shall be transferred to the [Corporation](/usc/12/5301.md?p=7) on the [transfer date](/usc/12/5301.md?p=17); and
- (3) relating to the functions of the [Office](/usc/12/5341.md?p=1) of Thrift Supervision transferred under [section 5412(b)(1)(A) of this title](/usc/12/5412.md?p=b-1-A), shall be transferred to the [Board of Governors](/usc/12/5301.md?p=3) on the [transfer date](/usc/12/5301.md?p=17).
