Interim use of funds, personnel, and property of the Office of Thrift Supervision - (a) **In general—** Before the [transfer date](/usc/12/5301.md?p=17), the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) shall— - (1) consult and cooperate with the [Office](/usc/12/5341.md?p=1) of Thrift Supervision to facilitate the orderly transfer of functions to the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) in accordance with this title;[^1] - (2) determine jointly, from time to time— - (A) the amount of [funds](/usc/12/5381.md?p=a-12) necessary to pay any expenses associated with the transfer of functions ([including](/usc/12/5301.md?p=18-A) expenses for personnel, property, and administrative services) during the period beginning on July 21, 2010, and ending on the [transfer date](/usc/12/5301.md?p=17); - (B) which personnel are appropriate to facilitate the orderly transfer of functions by this title;[^1] and - (C) what property and administrative services are necessary to support the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) during the period beginning on July 21, 2010, and ending on the [transfer date](/usc/12/5301.md?p=17); and - (3) take such actions as may be necessary to provide for the orderly implementation of this title.[^1] - (b) **Agency consultation—** When requested jointly by the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) to do so before the [transfer date](/usc/12/5301.md?p=17), the [Office](/usc/12/5341.md?p=1) of Thrift Supervision shall— - (1) pay to the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), or the [Board of Governors](/usc/12/5301.md?p=3), as applicable, from [funds](/usc/12/5381.md?p=a-12) obtained by the [Office](/usc/12/5341.md?p=1) of Thrift Supervision through assessments, fees, or other charges that the [Office](/usc/12/5341.md?p=1) of Thrift Supervision is authorized by law to impose, such amounts as the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) jointly determine to be necessary under [subsection (a)](#a); - (2) detail to the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), or the [Board of Governors](/usc/12/5301.md?p=3), as applicable, such personnel as the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) jointly determine to be appropriate under [subsection (a)](#a); and - (3) make available to the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), or the [Board of Governors](/usc/12/5301.md?p=3), as applicable, such property and provide to the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), or the [Board of Governors](/usc/12/5301.md?p=3), as applicable, such administrative services as the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) jointly determine to be necessary under [subsection (a)](#a). - (c) **Notice required—** The [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) shall jointly give the [Office](/usc/12/5341.md?p=1) of Thrift Supervision reasonable prior notice of any request that the [Office](/usc/12/5341.md?p=1) of the Comptroller of the Currency, the [Corporation](/usc/12/5301.md?p=7), and the [Board of Governors](/usc/12/5301.md?p=3) jointly intend to make under [subsection (b)](#b). ## Footnotes [^1]: See References in Text note below. ## Source credit (Pub.
