# §5004. Substitute check warranties


A [bank](/usc/12/5002.md?p=2) that transfers, presents, or returns a [substitute check](/usc/12/5002.md?p=16) and receives consideration for the [check](/usc/12/5002.md?p=6) warrants, as a matter of law, to the transferee, any subsequent collecting or [returning bank](/usc/12/5002.md?p=3-D-i), the [depositary bank](/usc/12/5002.md?p=3-B), the drawee, the drawer, the payee, the depositor, and any endorser (regardless of whether the warrantee receives the [substitute check](/usc/12/5002.md?p=16) or another paper or electronic form of the [substitute check](/usc/12/5002.md?p=16) or original [check](/usc/12/5002.md?p=6)) that—

- (1) the [substitute check](/usc/12/5002.md?p=16) meets all the requirements for legal equivalence under [section 5003(b) of this title](/usc/12/5003.md?p=b); and
- (2) no [depositary bank](/usc/12/5002.md?p=3-B), drawee, drawer, or endorser will receive presentment or return of the [substitute check](/usc/12/5002.md?p=16), the original [check](/usc/12/5002.md?p=6), or a copy or other paper or electronic version of the [substitute check](/usc/12/5002.md?p=16) or original [check](/usc/12/5002.md?p=6) such that the [bank](/usc/12/5002.md?p=2), drawee, drawer, or endorser will be asked to make a payment based on a [check](/usc/12/5002.md?p=6) that the [bank](/usc/12/5002.md?p=2), drawee, drawer, or endorser has already paid.
