# §1520. Effects of recognition of a foreign main proceeding

- (a) Upon [recognition](/usc/11/1502.md?p=7) of a [foreign proceeding](/usc/11/101.md?p=23) that is a [foreign main proceeding](/usc/11/1502.md?p=4)—
  - (1) sections [361](/usc/11/361.md) and [362](/usc/11/362.md) apply with respect to the [debtor](/usc/11/1502.md?p=1) and the property of the [debtor](/usc/11/1502.md?p=1) that is within the territorial jurisdiction of the [United States](/usc/11/101.md?p=55);
  - (2) sections [363](/usc/11/363.md), [549](/usc/11/549.md), and [552](/usc/11/552.md) apply to a [transfer](/usc/11/101.md?p=54) of an interest of the [debtor](/usc/11/1502.md?p=1) in property that is within the territorial jurisdiction of the [United States](/usc/11/101.md?p=55) to the same extent that the sections would apply to property of an estate;
  - (3) unless the court orders otherwise, the [foreign representative](/usc/11/101.md?p=24) may operate the [debtor](/usc/11/1502.md?p=1)’s business and may exercise the rights and powers of a [trustee](/usc/11/1502.md?p=6) under and to the extent provided by sections [363](/usc/11/363.md) and [552](/usc/11/552.md); and
  - (4) [section 552](/usc/11/552.md) applies to property of the [debtor](/usc/11/1502.md?p=1) that is within the territorial jurisdiction of the [United States](/usc/11/101.md?p=55).
- (b) [Subsection (a)](#a) does not affect the right to commence an individual action or proceeding in a foreign country to the extent necessary to preserve a [claim](/usc/11/101.md?p=5) against the [debtor](/usc/11/1502.md?p=1).
- (c) [Subsection (a)](#a) does not affect the right of a [foreign representative](/usc/11/101.md?p=24) or an [entity](/usc/11/101.md?p=15) to file a [petition](/usc/11/101.md?p=42) commencing a case under this title or the right of any party to file [claims](/usc/11/101.md?p=5) or take other proper actions in such a case.
