# §1115. Property of the estate

- (a) In a case in which the [debtor](/usc/11/101.md?p=13) is an individual, property of the estate includes, in addition to the property specified in [section 541](/usc/11/541.md)—
  - (1) all property of the kind specified in [section 541](/usc/11/541.md) that the [debtor](/usc/11/101.md?p=13) acquires after the commencement of the case but before the case is closed, dismissed, or converted to a case under chapter [7](/usc/11/chch7.md), [12](/usc/11/chch12.md), or [13](/usc/11/chch13.md), whichever occurs first; and
  - (2) earnings from services performed by the [debtor](/usc/11/101.md?p=13) after the commencement of the case but before the case is closed, dismissed, or converted to a case under chapter [7](/usc/11/chch7.md), [12](/usc/11/chch12.md), or [13](/usc/11/chch13.md), whichever occurs first.
- (b) Except as provided in [section 1104](/usc/11/1104.md) or a confirmed plan or order confirming a plan, the [debtor](/usc/11/101.md?p=13) shall remain in possession of all property of the estate.
