# §8335. Restoration to former grade: warrant officers and enlisted members


Each retired [warrant officer](/usc/10/8001.md?p=a-7) or [enlisted member](/usc/10/8001.md?p=a-4) of the naval service who has been advanced on the retired list to a higher commissioned [grade](/usc/10/101.md?p=b-7) under [section 8334 of this title](/usc/10/8334.md), and who applies to the [Secretary](/usc/10/8720.md?p=4) of the [Navy](/usc/10/8001.md?p=a-1) within three months after his advancement, shall, if the [Secretary](/usc/10/8720.md?p=4) approves, be restored on the retired list to his former [warrant officer](/usc/10/8001.md?p=a-7) or enlisted status, as the case may be.
