# §6339. Limitation on establishing an enduring bioassurance program within the administration

- (a) **In General.—** The [Administrator](/usc/10/2700.md?p=3) may not establish, administer, manage, or facilitate a [program](/usc/10/2101.md?p=1) within the Administration for the purposes of executing an enduring [national security](/usc/10/801.md?p=16) research and development effort to broaden the role of the [Department](/usc/10/101.md?p=a-6) of Energy in national biodefense.
- (b) **Rule of Construction.—** The limitation described in [subsection (a)](#a) shall not be interpreted—
  - (1) to prohibit the establishment of a bioassurance [program](/usc/10/2101.md?p=1) for the purpose of executing enduring [national security](/usc/10/801.md?p=16) research and development in any [component](/usc/10/3011.md?p=13) of the [Department](/usc/10/101.md?p=a-6) of Energy other than the Administration or in any other Federal [agency](/usc/10/3451.md?p=3); or
  - (2) to impede the use of resources of the Administration, including resources provided by a [national security](/usc/10/801.md?p=16) laboratory or a nuclear weapons production [facility](/usc/10/2700.md?p=2) site, to support the execution of a bioassurance [program](/usc/10/2101.md?p=1), if such support is provided—
    - (A) on a cost-reimbursable basis to an entity that is not a [component](/usc/10/3011.md?p=13) of the [Department](/usc/10/101.md?p=a-6) of Energy; and
    - (B) in a manner that does not interfere with mission of such laboratory or [facility](/usc/10/2700.md?p=2).
