# §6223. Background investigations of certain personnel at Department of Energy facilities


The [Secretary](/usc/10/4951.md?p=3) of Energy shall ensure that an investigation meeting the requirements of section 145 of the Atomic Energy Act of 1954 ([42 U.S.C. 2165](/usc/42/2165.md)) is made for each [Department](/usc/10/101.md?p=a-6) of Energy employee, or contractor employee, at a [national security](/usc/10/801.md?p=16) laboratory or nuclear weapons production [facility](/usc/10/2700.md?p=2) who—

- (1) carries out duties or responsibilities in or around a location where Restricted Data is present; or
- (2) has or may have [regular](/usc/10/101.md?p=b-12) access to a location where Restricted Data is present.
