# §583. Definitions


In this chapter:

- (1) The term “promotion zone” means a promotion eligibility category consisting of [officers](/usc/10/101.md?p=b-1) on a [warrant officer](/usc/10/101.md?p=b-3) [active-duty list](/usc/10/101.md?p=b-13) in the same [grade](/usc/10/101.md?p=b-7) (or the same [grade](/usc/10/101.md?p=b-7) and competitive category) who—
  - (A) in the case of [grades](/usc/10/101.md?p=b-7) below chief [warrant officer](/usc/10/101.md?p=b-3), W–5, have neither (i) failed of selection for promotion to the next higher [grade](/usc/10/101.md?p=b-7), nor (ii) been removed from a list of [warrant officers](/usc/10/101.md?p=b-3) recommended for promotion to that [grade](/usc/10/101.md?p=b-7) (other than after having been placed on that list after a selection from below the [promotion zone](#1)); and
  - (B) are senior to the [warrant officer](/usc/10/101.md?p=b-3) designated by the [Secretary concerned](/usc/10/2801.md?p=c-5) to be the junior [warrant officer](/usc/10/101.md?p=b-3) in the [promotion zone](#1) eligible for promotion to the next higher [grade](/usc/10/101.md?p=b-7).
- (2) The term “warrant officers above the promotion zone” means a group of [officers](/usc/10/101.md?p=b-1) on a [warrant officer](/usc/10/101.md?p=b-3) [active-duty list](/usc/10/101.md?p=b-13) in the same [grade](/usc/10/101.md?p=b-7) (or the same [grade](/usc/10/101.md?p=b-7) and competitive category) who—
  - (A) are eligible for consideration for promotion to the next higher [grade](/usc/10/101.md?p=b-7);
  - (B) are in the same [grade](/usc/10/101.md?p=b-7) as [warrant officers](/usc/10/101.md?p=b-3) in the [promotion zone](#1); and
  - (C) are senior to the senior [warrant officer](/usc/10/101.md?p=b-3) in the [promotion zone](#1).
- (3) The term “warrant officers below the promotion zone” means a group of [officers](/usc/10/101.md?p=b-1) on a [warrant officer](/usc/10/101.md?p=b-3) [active-duty list](/usc/10/101.md?p=b-13) in the same [grade](/usc/10/101.md?p=b-7) (or the same [grade](/usc/10/101.md?p=b-7) and competitive category) who—
  - (A) are eligible for consideration for promotion to the next higher [grade](/usc/10/101.md?p=b-7);
  - (B) are in the same [grade](/usc/10/101.md?p=b-7) as [warrant officers](/usc/10/101.md?p=b-3) in the [promotion zone](#1); and
  - (C) are junior to the junior [warrant officer](/usc/10/101.md?p=b-3) in the [promotion zone](#1).
- (4) The [active-duty list](/usc/10/101.md?p=b-13) referred to in [section 573(b) of this title](/usc/10/573.md?p=b) [includes](/usc/10/101.md?p=g-4) the active-duty promotion list established by section 41a[^1] of title 14.
