# §500d. Electromagnetic spectrum superiority implementation plan

- (a) **In General.—** The Chief Information [Officer](/usc/10/101.md?p=b-1) of the [Department](/usc/10/101.md?p=a-6) of Defense shall be responsible for oversight of the electromagnetic superiority implementation plan.
- (b) **Report Required.—** Concurrent with the submission of the budget of the President to Congress under [section 1105(a) of title 31](/usc/31/1105.md?p=a) for each of fiscal years 2025 through 2029, the Chief Information [Officer](/usc/10/101.md?p=b-1) shall submit to the [congressional defense committees](/usc/10/101.md?p=a-16) a report that [includes](/usc/10/101.md?p=g-4) the following with respect to the electromagnetic superiority implementation plan:
  - (1) The implementation plan in effect as of the date of the report, noting any revisions from the preceding plan.
  - (2) A statement of the elements of the implementation plan that have been achieved.
  - (3) For each element that has been achieved, an assessment of whether the element is having its intended effect.
  - (4) For any element that has not been achieved, an assessment of progress made in achieving the element, including a description of any obstacles that may hinder further progress.
  - (5) For any element that has been removed from the implementation plan, a description of the reason for the [removal](/usc/10/2700.md?p=2) of the element and an assessment of the impact of not pursuing achievement of the element.
  - (6) Such additional matters as the Chief Information [Officer](/usc/10/101.md?p=b-1) considers appropriate.
- (c) **Electromagnetic Superiority Implementation Plan Defined.—** In this section, the term “electromagnetic superiority implementation plan” means the Electromagnetic Superiority Implementation Plan signed by the [Secretary](/usc/10/4951.md?p=3) of Defense on July 15, 2021, and any successor plan.
