# §443. Imagery intelligence and geospatial information: support for foreign countries, regional organizations, and security alliances

- (a) **Use of Appropriated Funds.—** The Director of the National Geospatial-Intelligence [Agency](/usc/10/3451.md?p=3) may use appropriated funds available to the National Geospatial-Intelligence [Agency](/usc/10/3451.md?p=3) to provide foreign countries, regional organizations with defense or security [components](/usc/10/3011.md?p=13), and security alliances of which the [United States](/usc/10/101.md?p=a-1) is a member with [imagery intelligence](/usc/10/467.md?p=3) and [geospatial information](/usc/10/467.md?p=4) support.
- (b) **Use of Funds Other Than Appropriated Funds.—** The Director may use funds other than appropriated funds to provide foreign countries with [imagery intelligence](/usc/10/467.md?p=3) and [geospatial information](/usc/10/467.md?p=4) support, notwithstanding provisions of law relating to the expenditure of funds of the [United States](/usc/10/101.md?p=a-1), except that—
  - (1) no such funds may be expended, in whole or in part, by or for the benefit of the National Geospatial-Intelligence [Agency](/usc/10/3451.md?p=3) for a purpose for which Congress had previously denied funds;
  - (2) proceeds from the sale of [imagery intelligence](/usc/10/467.md?p=3) or [geospatial information](/usc/10/467.md?p=4) items may be used only to purchase replacement items similar to the items that are sold; and
  - (3) the authority provided by this subsection may not be used to acquire items or services for the principal benefit of the [United States](/usc/10/101.md?p=a-1).
- (c) **Accommodation Procurements.—** The authority under this section may be exercised to conduct accommodation [procurements](/usc/10/3011.md?p=1) on behalf of foreign countries.
- (d) **Coordination With Director of National Intelligence.—** The Director of the [Agency](/usc/10/3451.md?p=3) shall coordinate with the Director of National Intelligence any action under this section that involves [imagery intelligence](/usc/10/467.md?p=3) or intelligence products or involves providing support to an intelligence or security service of a foreign country.

### Effective Date of 2009 Amendment

Pub. L. 111–84, div. A, title X, § 1073(c), Oct. 28, 2009, 123 Stat. 2474, provided that the amendment made by section 1073(c)(10) is effective as of Oct. 14, 2008, and as if included in Pub. L. 110–417 as enacted.
