# §3375. Undefinitized contractual actions: time limit


No [undefinitized contractual action](/usc/10/3377.md?p=b-1) may extend beyond 90 days without a written determination by the [Secretary](/usc/10/4951.md?p=3) of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) concerned, the head of the [Defense Agency](/usc/10/101.md?p=a-11) concerned, the commander of the combatant command concerned, or the Under [Secretary](/usc/10/4951.md?p=3) of Defense for Acquisition and Sustainment (as applicable) that it is in the best interests of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6), the [Defense Agency](/usc/10/101.md?p=a-11), the combatant command, or the [Department](/usc/10/101.md?p=a-6) of Defense, respectively, to continue the action.
