# §322. Special operations forces: training with friendly foreign forces

- (a) **Authority To Pay Training Expenses.—** Under regulations prescribed pursuant to [subsection (c)](#c), the commander of the special operations command established pursuant to [section 167 of this title](/usc/10/167.md) and the commander of any other unified or specified combatant command may [pay](/usc/10/101.md?p=a-15), or authorize payment for, any of the following expenses:
  - (1) Expenses of [training](/usc/10/301.md?p=9) special operations forces assigned to that command in conjunction with [training](/usc/10/301.md?p=9), and [training](/usc/10/301.md?p=9) with, [armed forces](/usc/10/101.md?p=a-4) and other security forces of a friendly foreign country.
  - (2) Expenses of deploying such special operations forces for that [training](/usc/10/301.md?p=9).
  - (3) In the case of [training](/usc/10/301.md?p=9) in conjunction with a friendly [developing country](/usc/10/301.md?p=4), the [incremental expenses](/usc/10/301.md?p=5) incurred by that country as the direct result of such [training](/usc/10/301.md?p=9).
- (b) **Purpose of Training.—** The primary purpose of the [training](/usc/10/301.md?p=9) for which payment may be made under [subsection (a)](#a) shall be to train the special operations forces of the combatant command.
- (c) **Regulations.—** The [Secretary](/usc/10/4951.md?p=3) of Defense shall prescribe regulations for the administration of this section. The regulations shall require that [training](/usc/10/301.md?p=9) activities may be carried out under this section only with the prior approval of the [Secretary](/usc/10/4951.md?p=3) of Defense. The regulations shall establish accounting procedures to ensure that the expenditures pursuant to this section are appropriate.
- (d) **Definitions.—** In this section:
  - (1) The term “special operations forces” [includes](/usc/10/101.md?p=g-4) civil affairs forces and [military](/usc/10/801.md?p=8) information support operations forces.
  - (2) The term “[incremental expenses](/usc/10/301.md?p=5)”, with respect to a [developing country](/usc/10/301.md?p=4), means the reasonable and proper cost of rations, fuel, [training](/usc/10/301.md?p=9) ammunition, transportation, and other goods and services consumed by such country, except that the term does not include [pay](/usc/10/101.md?p=a-15), allowances, and other normal costs of such country’s personnel.
- (e) **Reports.—** Not later than April 1 of each year, the [Secretary](/usc/10/4951.md?p=3) of Defense shall submit to Congress a report regarding [training](/usc/10/301.md?p=9) during the preceding fiscal year for which expenses were paid under this section. Each report shall specify the following:
  - (1) All countries in which that [training](/usc/10/301.md?p=9) was conducted.
  - (2) The type of [training](/usc/10/301.md?p=9) conducted, including whether such [training](/usc/10/301.md?p=9) was related to counter-narcotics or counter-terrorism activities, the duration of that [training](/usc/10/301.md?p=9), the number of members of the [armed forces](/usc/10/101.md?p=a-4) involved, and expenses paid.
  - (3) The extent of participation by foreign [military](/usc/10/801.md?p=8) forces, including the number and service affiliation of foreign [military](/usc/10/801.md?p=8) personnel involved and physical and financial contribution of each host nation to the [training](/usc/10/301.md?p=9) effort.
  - (4) The relationship of that [training](/usc/10/301.md?p=9) to other overseas [training](/usc/10/301.md?p=9) [programs](/usc/10/2101.md?p=1) conducted by the [armed forces](/usc/10/101.md?p=a-4), such as [military](/usc/10/801.md?p=8) exercise [programs](/usc/10/2101.md?p=1) sponsored by the Joint Chiefs of Staff, [military](/usc/10/801.md?p=8) exercise [programs](/usc/10/2101.md?p=1) sponsored by a combatant command, and [military](/usc/10/801.md?p=8) [training](/usc/10/301.md?p=9) activities sponsored by a [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) (including deployments for [training](/usc/10/301.md?p=9), short duration exercises, and other similar unit [training](/usc/10/301.md?p=9) events).
  - (5) A summary of the expenditures under this section resulting from the [training](/usc/10/301.md?p=9) for which expenses were paid under this section.
  - (6) A discussion of the unique [military](/usc/10/801.md?p=8) [training](/usc/10/301.md?p=9) benefit to [United States](/usc/10/101.md?p=a-1) special operations forces derived from the [training](/usc/10/301.md?p=9) activities for which expenses were paid under this section.
