# §2881. Ancillary supporting facilities

- (a) **Authority To Acquire or Construct.—** Any project for the acquisition or [construction](/usc/10/2871.md?p=3) of [military](/usc/10/801.md?p=8) family [housing units](/usc/10/2871.md?p=8) or [military unaccompanied housing](/usc/10/2871.md?p=11) units under this subchapter may include the acquisition or [construction](/usc/10/2871.md?p=3) of [ancillary supporting facilities](/usc/10/2871.md?p=1) for the [housing units](/usc/10/2871.md?p=8) concerned.
- (b) **Restriction.—** A project referred to in [subsection (a)](#a) may not include the acquisition or [construction](/usc/10/2871.md?p=3) of an ancillary supporting [facility](/usc/10/2700.md?p=2) (other than a [child development center](/usc/10/2871.md?p=2)) if, as determined by the [Secretary concerned](/usc/10/2801.md?p=c-5), the [facility](/usc/10/2700.md?p=2) is to be used for providing merchandise or services in direct competition with—
  - (1) the Army and Air Force Exchange Service;
  - (2) the Navy Exchange Service Command;
  - (3) a Marine Corps exchange;
  - (4) the Defense Commissary [Agency](/usc/10/3451.md?p=3); or
  - (5) any nonappropriated [fund](/usc/10/2871.md?p=6) activity of the [Department](/usc/10/101.md?p=a-6) of Defense for the morale, welfare, and recreation of members of the [armed forces](/usc/10/101.md?p=a-4).
