# §2694d. Participation in pollutant banks and water quality trading

- (a) **Authority to Participate.—** The [Secretary](/usc/10/4951.md?p=3) of a [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6), and the [Secretary](/usc/10/4951.md?p=3) of Defense with respect to matters concerning a [Defense Agency](/usc/10/101.md?p=a-11), when engaged in an authorized activity that may or will result in the discharge of pollutants, may make payments to a pollutant banking [program](/usc/10/2101.md?p=1) or water quality trading [program](/usc/10/2101.md?p=1) approved in accordance with the Water Quality Trading Policy dated January 13, 2003, set forth by the Office of Water of the Environmental Protection [Agency](/usc/10/3451.md?p=3), or any successor administrative guidance or regulation.
- (b) **Treatment of Payments.—** Payments made under [subsection (a)](#a) to a pollutant banking [program](/usc/10/2101.md?p=1) or water quality trading [program](/usc/10/2101.md?p=1) may be treated as eligible project costs for [military construction](/usc/10/2801.md?p=a).
- (c) **Discharge of Pollutants Defined.—** In this section, the term “discharge of pollutants” has the meaning given that term in section 502(12) of the Federal Water Pollution Control Act ([33 U.S.C. 1362(12)](/usc/33/1362.md?p=12)) (commonly referred to as the “Clean Water Act”).
