# §2560. Aircraft and vehicles: limitation on leasing to non-Federal agencies


The [Secretary](/usc/10/4951.md?p=3) of Defense (or [Secretary](/usc/10/4951.md?p=3) of a [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6)) may not lease to a non-Federal [agency](/usc/10/3451.md?p=3) in the [United States](/usc/10/101.md?p=a-1) any aircraft or vehicle owned or operated by the [Department](/usc/10/101.md?p=a-6) of Defense if suitable aircraft or vehicles are commercially available in the private sector. However, nothing in the preceding sentence shall affect authorized and established procedures for the sale of surplus aircraft or vehicles.
