# §239b. Certain intelligence-related programs: budget justification materials

- (a) **Prohibition on Use of Program Elements.—** In the budget justification materials submitted to Congress in support of the [Department](/usc/10/101.md?p=a-6) of Defense budget for fiscal year 2021 and each fiscal year thereafter (as submitted with the budget of the President under [section 1105(a) of title 31](/usc/31/1105.md?p=a)), the [Secretary](/usc/10/4951.md?p=3) of Defense may not include in any single [program](/usc/10/2101.md?p=1) element both funds made available under the [Military](/usc/10/801.md?p=8) Intelligence [Program](/usc/10/2101.md?p=1) and funds made available outside of the [Military](/usc/10/801.md?p=8) Intelligence [Program](/usc/10/2101.md?p=1).
- (b) **Definitions.—** In this section:
  - (1) The term “budget” has the meaning given that term in [section 231(f)](/usc/10/231.md?p=f)[^1] of this title.
  - (2) The term “defense budget materials” has the meaning given that term in [section 231(f)](/usc/10/231.md?p=f)[^1] of this title.
