# §2205. Reimbursements

- (a) **Availability of Reimbursements.—** Reimbursements made to appropriations of the [Department](/usc/10/101.md?p=a-6) of Defense or a [department](/usc/10/101.md?p=a-6) or [agency](/usc/10/3451.md?p=3) thereof under sections [1535](/usc/31/1535.md) and [1536](/usc/31/1536.md) of title 31, or other amounts paid by or on behalf of a [department](/usc/10/101.md?p=a-6) or [agency](/usc/10/3451.md?p=3) of the [Department](/usc/10/101.md?p=a-6) of Defense to another [department](/usc/10/101.md?p=a-6) or [agency](/usc/10/3451.md?p=3) of the [Department](/usc/10/101.md?p=a-6) of Defense, or by or on behalf of personnel of any [department](/usc/10/101.md?p=a-6) or organization, for services rendered or [supplies](/usc/10/3011.md?p=8) furnished, may be credited to authorized accounts. Funds so credited are available for obligation for the same period as the funds in the account so credited. Such an account shall be [accounted for](/usc/10/1513.md?p=3) as one fund on the books of the [Department](/usc/10/101.md?p=a-6) of the Treasury.
- (b) **Fixed Rate for Reimbursement for Certain Services.—** The [Secretary](/usc/10/4951.md?p=3) of Defense and the [Secretaries](/usc/10/4951.md?p=3) of the [military departments](/usc/10/101.md?p=a-8) may charge a fixed [rate](/usc/10/101.md?p=b-9) for reimbursement of the costs of providing planning, supervision, administrative, or overhead services incident to any construction, maintenance, or repair project to real property or for providing [facility](/usc/10/2700.md?p=2) services, irrespective of the appropriation financing the project or [facility](/usc/10/2700.md?p=2) services.

5 U.S.C. 172g is restated to reflect more clearly its purpose to authorize the Department of Defense to operate as an integrated department by permitting supplies to be furnished and services to be rendered within and among agencies of the Department of Defense and provide that reimbursements therefor be credited to authorized accounts and be available for the same purpose and period as the accounts so credited. (See Senate Report No. 366, 81st Congress, pp. 23, 24.)
