# §2182. Educational assistance: dependents of captives

- (a) Under regulations prescribed by the President, the [Secretary concerned](/usc/10/2801.md?p=c-5) shall [pay](/usc/10/101.md?p=a-15) (by advancement or reimbursement) a [dependent](/usc/10/1072.md?p=2) of a [person](/usc/10/2700.md?p=2) who is in a [captive status](/usc/10/2181.md?p=1) for expenses incurred, while attending an educational or [training](/usc/10/301.md?p=9) institution, for—
  - (1) subsistence;
  - (2) tuition;
  - (3) fees;
  - (4) [supplies](/usc/10/3011.md?p=8);
  - (5) books;
  - (6) equipment; and
  - (7) other educational expenses.
- (b) Except as provided in [section 2184 of this title](/usc/10/2184.md), payments shall be available under this section for a [dependent](/usc/10/1072.md?p=2) of a [person](/usc/10/2700.md?p=2) who is in a [captive status](/usc/10/2181.md?p=1) for education or [training](/usc/10/301.md?p=9) that occurs—
  - (1) after that [person](/usc/10/2700.md?p=2) is in a [captive status](/usc/10/2181.md?p=1) for not less than 90 days; and
  - (2) on or before—
    - (A) the end of any semester or quarter (as appropriate) that begins before the date on which the [captive status](/usc/10/2181.md?p=1) of that [person](/usc/10/2700.md?p=2) terminates;
    - (B) the earlier of the end of any course that began before such date or the end of the 16-week period following that date if the educational or [training](/usc/10/301.md?p=9) institution is not operated on a semester or quarter system; or
    - (C) a date specified by the [Secretary concerned](/usc/10/2801.md?p=c-5) in order to respond to special circumstances.
- (c) If a [person](/usc/10/2700.md?p=2) in a [captive status](/usc/10/2181.md?p=1) or a [former captive](/usc/10/2181.md?p=1) dies and the death is incident to the captivity, payments shall be available under this section for a [dependent](/usc/10/1072.md?p=2) of that [person](/usc/10/2700.md?p=2) for education or [training](/usc/10/301.md?p=9) that occurs after the date of the death of that [person](/usc/10/2700.md?p=2).
- (d) The provisions of this section shall not apply to any [dependent](/usc/10/1072.md?p=2) who is eligible for assistance under [chapter 35](/usc/38/chptIII/ch35.md) of title 38 or similar assistance under any other provision of law.
