# §2122. Eligibility for participation

- (a) To be eligible for participation as a [member of the program](/usc/10/2120.md?p=2), a [person](/usc/10/2700.md?p=2) must be a citizen of the [United States](/usc/10/101.md?p=a-1) and must—
  - (1) be accepted for admission to, or enrolled in, an institution in a [course of study](/usc/10/2120.md?p=3) or selected to receive [specialized training](/usc/10/2120.md?p=4);
  - (2) sign an agreement that unless sooner separated he will—
    - (A) complete the educational phase of the [program](/usc/10/2120.md?p=1);
    - (B) accept an appropriate reappointment or designation within his [military](/usc/10/801.md?p=8) service, if tendered, based upon his health profession, following satisfactory completion of the [program](/usc/10/2120.md?p=1);
    - (C) participate in the intern [program](/usc/10/2120.md?p=1) of his service if selected for such participation;
    - (D) participate in the residency [program](/usc/10/2120.md?p=1) of his service, if selected, or be released from [active duty](/usc/10/101.md?p=d-1) for the period required to undergo civilian residency if selected for such [training](/usc/10/301.md?p=9); and
    - (E) because of his sincere motivation and dedication to a career in the [uniformed services](/usc/10/1072.md?p=1), participate in [military](/usc/10/801.md?p=8) [training](/usc/10/301.md?p=9) while he is in the [program](/usc/10/2120.md?p=1), under regulations prescribed by the [Secretary](/usc/10/4951.md?p=3) of Defense; and
  - (3) meet the requirements for appointment as a [commissioned officer](/usc/10/101.md?p=b-2).
- (b) The [Secretary](/usc/10/4951.md?p=3) of Defense may require, as part of the agreement under [subsection (a)(2)](#a-2), that a [person](/usc/10/2700.md?p=2) must agree to accept, if offered, residency [training](/usc/10/301.md?p=9) in a health profession skill which has been designated by the [Secretary](/usc/10/4951.md?p=3) as a critically needed wartime skill.
