# §2108. Advanced standing; interruption of training; delay in starting obligated service; release from program

- (a) The [Secretary](/usc/10/4951.md?p=3) of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) concerned may give to any [enlisted member](/usc/10/101.md?p=b-6) of an armed force under his jurisdiction, or any [person](/usc/10/2700.md?p=2) who has served on [active duty](/usc/10/101.md?p=d-1) in any armed force, such advanced standing in the [program](/usc/10/2101.md?p=1) as may be justified by his education and [training](/usc/10/301.md?p=9).
- (b) In determining a member’s eligibility for [advanced training](/usc/10/2101.md?p=3), the [Secretary](/usc/10/4951.md?p=3) of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) concerned may credit him with any [military](/usc/10/801.md?p=8) [training](/usc/10/301.md?p=9) that is substantially equivalent in kind to that prescribed for admission to [advanced training](/usc/10/2101.md?p=3) and was received while he was taking a course of instruction in a [program](/usc/10/2101.md?p=1) under the jurisdiction of another armed force or while he was on [active duty](/usc/10/101.md?p=d-1) in the [armed forces](/usc/10/101.md?p=a-4).
- (c) The [Secretary](/usc/10/4951.md?p=3) of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) concerned may excuse from a portion of the prescribed course of [military](/usc/10/801.md?p=8) instruction, including field [training](/usc/10/301.md?p=9) and practice cruises, any [person](/usc/10/2700.md?p=2) found qualified on the basis of his previous education, [military](/usc/10/801.md?p=8) experience, or both.
- (d) A [person](/usc/10/2700.md?p=2) may become, remain, or be readmitted as, a member of the [advanced training](/usc/10/2101.md?p=3) [program](/usc/10/2101.md?p=1) after receiving a baccalaureate degree or completing pre-professional studies if he has not completed the course of [military](/usc/10/801.md?p=8) instruction or all field [training](/usc/10/301.md?p=9) or practice cruises prescribed by the [Secretary](/usc/10/4951.md?p=3) of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) concerned. If a [member of the program](/usc/10/2101.md?p=2) has been accepted for resident graduate or professional study, the [Secretary](/usc/10/4951.md?p=3) of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) concerned may delay the commencement of that member’s obligated period of [active duty](/usc/10/101.md?p=d-1), and any obligated period of [active duty](/usc/10/101.md?p=d-1) for [training](/usc/10/301.md?p=9) or other service in an active or inactive status in a [reserve](/usc/10/101.md?p=c-6) [component](/usc/10/3011.md?p=13), until the member has completed that study. If a [cadet](/usc/10/801.md?p=6) appointed under [section 2107a of this title](/usc/10/2107a.md) has been accepted for a course of study at an accredited civilian educational institution authorized to grant baccalaureate degrees, the [Secretary](/usc/10/4951.md?p=3) of the Army may delay the beginning of that member’s obligated period of service in a [reserve](/usc/10/101.md?p=c-6) [component](/usc/10/3011.md?p=13) until the member has completed such course of study.
- (e) The [Secretary](/usc/10/4951.md?p=3) of the [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) concerned may, when he determines that the interest of the service so requires, [release](/usc/10/2700.md?p=2) any [person](/usc/10/2700.md?p=2) from the [program](/usc/10/2101.md?p=1) and discharge him from his armed force.
