# §2034. Educational institutions not maintaining units of Junior Reserve Officers’ Training Corps: issuance of arms, tentage, and equipment


The [Secretary](/usc/10/4951.md?p=3) of a [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) may issue arms, tentage, and equipment to an educational institution at which no unit of the Junior [Reserve](/usc/10/101.md?p=c-6) [Officers](/usc/10/101.md?p=b-1)’ [Training](/usc/10/301.md?p=9) Corps is maintained if the educational institution—

- (1) offers a course in [military](/usc/10/801.md?p=8) [training](/usc/10/301.md?p=9) prescribed by that [Secretary](/usc/10/4951.md?p=3); and
- (2) has a student body of at least 50 students who are in a [grade](/usc/10/101.md?p=b-7) above the eighth [grade](/usc/10/101.md?p=b-7).
