# §20106. Orders to active duty: without consent of member

- (a) **Members in a Space Force Active Status.—**
  - (1) A member of the Space Force in a [space force active status](/usc/10/101.md?p=e-1) who is not on [sustained duty](/usc/10/101.md?p=e-4), may, without the consent of the member, be ordered to [active duty](/usc/10/101.md?p=d-1) or inactive duty in the same manner as a member of a [reserve](/usc/10/101.md?p=c-6) component ordered to [active duty](/usc/10/101.md?p=d-1) or inactive duty under the provisions of [chapter 1209](/usc/10/chstE/ptII/ch1209.md) of this title and any other provision of law authorizing the order to [active duty](/usc/10/101.md?p=d-1) of a member of a [reserve](/usc/10/101.md?p=c-6) component in an [active status](/usc/10/101.md?p=d-4) without the consent of the member.
  - (2) The provisions of [chapter 1209](/usc/10/chstE/ptII/ch1209.md) of this title, or other applicable provisions of law, pertaining to a member of the Ready [Reserve](/usc/10/101.md?p=c-6) when ordered to [active duty](/usc/10/101.md?p=d-1) shall apply to a member of the Space Force who is in a [space force active status](/usc/10/101.md?p=e-1) when ordered to [active duty](/usc/10/101.md?p=d-1) under [paragraph (1)](#a-1).
  - (3) The provisions of [section 12304 of this title](/usc/10/12304.md) pertaining to members in the Individual Ready [Reserve](/usc/10/101.md?p=c-6) mobilization category shall apply to a member of the Space Force who is designated an Individual Ready Guardian when ordered to [active duty](/usc/10/101.md?p=d-1) who meets the provisions of [section 20102(b) of this title](/usc/10/20102.md?p=b).
- (b) **Members in a Space Force Inactive Status.—**
  - (1) A member of the Space Force in a [space force inactive status](/usc/10/101.md?p=e-2) may be ordered to [active duty](/usc/10/101.md?p=d-1) under—
    - (A) the provisions of [chapter 1209](/usc/10/chstE/ptII/ch1209.md) of this title;
    - (B) any other provision of law authorizing the order to [active duty](/usc/10/101.md?p=d-1) of a member of a [reserve](/usc/10/101.md?p=c-6) component in an inactive status; and
    - (C) the terms of any agreement entered into by the member under [section 20103 of this title](/usc/10/20103.md).
  - (2) The provisions of [chapter 1209](/usc/10/chstE/ptII/ch1209.md) of this title, or other applicable provisions of law, pertaining to the Standby [Reserve](/usc/10/101.md?p=c-6) shall apply to a member of the Space Force who is in a space force inactive service when ordered to [active duty](/usc/10/101.md?p=d-1).
- (c) **Members in a Space Force Retired Status.—**
  - (1) Chapters [39](/usc/10/chstA/ptII/ch39.md) and [1209](/usc/10/chstE/ptII/ch1209.md) of this title include provisions authorizing the order to [active duty](/usc/10/101.md?p=d-1) of a member of the Space Force in a [space force retired status](/usc/10/101.md?p=e-3).
  - (2) The provisions of sections [688](/usc/10/688.md), [688a](/usc/10/688a.md), and [12407](/usc/10/12407.md) of this title pertaining to a retired member or a member of the Retired [Reserve](/usc/10/101.md?p=c-6) shall apply to a member of the Space Force in a [space force retired status](/usc/10/101.md?p=e-3) when ordered to [active duty](/usc/10/101.md?p=d-1).
  - (3) The provisions of [section 689 of this title](/usc/10/689.md) pertaining to a retired member ordered to [active duty](/usc/10/101.md?p=d-1) shall apply to a member of the Space Force in a [space force retired status](/usc/10/101.md?p=e-3) who is ordered to [active duty](/usc/10/101.md?p=d-1).
- (d) **Other Applicable Provisions.—** The following provisions of [chapter 1209](/usc/10/chstE/ptII/ch1209.md) of this title shall apply to a member of the Space Force ordered to [active duty](/usc/10/101.md?p=d-1) in the same manner as to a [Reserve](/usc/10/101.md?p=c-6) or member of the Retired [Reserve](/usc/10/101.md?p=c-6) ordered to [active duty](/usc/10/101.md?p=d-1):
  - (1) [Section 12305](/usc/10/12305.md), relating to the authority of the President to suspend certain laws relating to promotion, retirement, and separation.
  - (2) [Section 12308](/usc/10/12308.md), relating to retention after becoming qualified for retired [pay](/usc/10/101.md?p=a-15).
  - (3) [Section 12313](/usc/10/12313.md), relating to release from [active duty](/usc/10/101.md?p=d-1).
  - (4) [Section 12314](/usc/10/12314.md), relating to kinds of duty.
  - (5) [Section 12315](/usc/10/12315.md), relating to duty with or without [pay](/usc/10/101.md?p=a-15).
  - (6) [Section 12316](/usc/10/12316.md), relating to payment of certain [Reserves](/usc/10/101.md?p=c-6) while on duty.
  - (7) [Section 12317](/usc/10/12317.md), relating to theological students; limitations.
  - (8) [Section 12320](/usc/10/12320.md), relating to [grade](/usc/10/101.md?p=b-7) in which ordered to [active duty](/usc/10/101.md?p=d-1).
