# §20104. Orders to active duty: with consent of member

- (a) **Authority.—** A member of the Space Force who is serving in a [space force active status](/usc/10/101.md?p=e-1) and is not on [sustained duty](/usc/10/101.md?p=e-4), or who is serving in a [space force inactive status](/usc/10/101.md?p=e-2), may, with the consent of the member, be ordered to [active duty](/usc/10/101.md?p=d-1), or retained on [active duty](/usc/10/101.md?p=d-1), under the following sections of [chapter 1209](/usc/10/chstE/ptII/ch1209.md) of this title in the same manner as applies to a member of a [reserve](/usc/10/101.md?p=c-6) component ordered to [active duty](/usc/10/101.md?p=d-1), or retained on [active duty](/usc/10/101.md?p=d-1), under that section with the consent of the member:
  - (1) [Section 12301(d)](/usc/10/12301.md?p=d), relating to orders to [active duty](/usc/10/101.md?p=d-1) at any time with the consent of the member.
  - (2) [Section 12301(h)](/usc/10/12301.md?p=h), relating to orders to [active duty](/usc/10/101.md?p=d-1) in connection with medical or health care matters.
  - (3) [Section 12322](/usc/10/12322.md), relating to [active duty](/usc/10/101.md?p=d-1) for health care.
  - (4) [Section 12323](/usc/10/12323.md), relating to [active duty](/usc/10/101.md?p=d-1) pending line of duty determination required for response to sexual assault.
- (b) **Applicable Provisions of Law.—** The following sections of [chapter 1209](/usc/10/chstE/ptII/ch1209.md) of this title pertaining to a member of a [reserve](/usc/10/101.md?p=c-6) component ordered to [active duty](/usc/10/101.md?p=d-1) with the consent of the member apply to a member of the Space Force who is ordered to [active duty](/usc/10/101.md?p=d-1) under this section in the same manner as to such a [reserve](/usc/10/101.md?p=c-6) component member:
  - (1) [Section 12308](/usc/10/12308.md), relating to retention after becoming qualified for retired [pay](/usc/10/101.md?p=a-15).
  - (2) [Section 12309](/usc/10/12309.md), relating to use of [Reserve](/usc/10/101.md?p=c-6) [officers](/usc/10/101.md?p=b-1) in expansion of [armed forces](/usc/10/101.md?p=a-4).
  - (3) [Section 12313](/usc/10/12313.md), relating to release of [reserve](/usc/10/101.md?p=c-6) members from [active duty](/usc/10/101.md?p=d-1).
  - (4) [Section 12314](/usc/10/12314.md), relating to kinds of duty.
  - (5) [Section 12315](/usc/10/12315.md), relating to duty with or without [pay](/usc/10/101.md?p=a-15).
  - (6) [Section 12316](/usc/10/12316.md), relating to payment of certain [Reserves](/usc/10/101.md?p=c-6) while on duty.
  - (7) [Section 12318](/usc/10/12318.md), relating to duties and funding of [reserve](/usc/10/101.md?p=c-6) members on [active duty](/usc/10/101.md?p=d-1).
  - (8) [Section 12320](/usc/10/12320.md), relating to [grade](/usc/10/101.md?p=b-7) in which ordered to [active duty](/usc/10/101.md?p=d-1).
  - (9) [Section 12321](/usc/10/12321.md), relating to a limitation on number of [reserve](/usc/10/101.md?p=c-6) members assigned to [Reserve](/usc/10/101.md?p=c-6) [Officer](/usc/10/101.md?p=b-1) Training Corps units.
