# §180. Service academy athletic programs: review board

- (a) **Independent Review Board.—** The [Secretary](/usc/10/4951.md?p=3) of Defense shall appoint a board to review the administration of the athletics [programs](/usc/10/2101.md?p=1) of the [United States](/usc/10/101.md?p=a-1) [Military](/usc/10/801.md?p=8) Academy, the [United States](/usc/10/101.md?p=a-1) Naval Academy, and the [United States](/usc/10/101.md?p=a-1) Air Force Academy.
- (b) **Composition of Board.—** The [Secretary](/usc/10/4951.md?p=3) shall appoint the members of the board from among distinguished [administrators](/usc/10/2700.md?p=3) of institutions of higher education, members of Congress, members of the Boards of Visitors of the academies, and other experts in collegiate athletics [programs](/usc/10/2101.md?p=1). The Superintendents of the three academies shall be members of the board. The [Secretary](/usc/10/4951.md?p=3) shall designate one member of the board, other than a Superintendent of an academy, as Chairman.
- (c) **Duties.—** The board shall, on an annual basis—
  - (1) review all aspects of the athletics [programs](/usc/10/2101.md?p=1) of the [United States](/usc/10/101.md?p=a-1) [Military](/usc/10/801.md?p=8) Academy, the [United States](/usc/10/101.md?p=a-1) Naval Academy, and the [United States](/usc/10/101.md?p=a-1) Air Force Academy, including—
    - (A) the policies relating to the administration of such [programs](/usc/10/2101.md?p=1);
    - (B) the appropriateness of the balance between the emphasis placed by each academy on athletics and the emphasis placed by such academy on academic pursuits; and
    - (C) the extent to which all athletes in all sports are treated equitably under the athletics [program](/usc/10/2101.md?p=1) of each academy; and
  - (2) determine ways in which the administration of the athletics [programs](/usc/10/2101.md?p=1) at the academies can serve as models for the administration of athletics [programs](/usc/10/2101.md?p=1) at civilian institutions of higher education.
- (d) **Administrative Provisions.—**
  - (1) Each member of the board who is not an [officer](/usc/10/101.md?p=b-1) or employee of the Federal Government shall be compensated at a [rate](/usc/10/101.md?p=b-9) equal to the daily equivalent of the annual [rate](/usc/10/101.md?p=b-9) of basic [pay](/usc/10/101.md?p=a-15) prescribed for Executive Schedule Level IV under [section 5315 of title 5](/usc/5/5315.md), for each day (including travel time) during which such member is engaged in the performance of the duties of the board. Members of the board who are [officers](/usc/10/101.md?p=b-1) or employees of the [United States](/usc/10/101.md?p=a-1) shall serve without compensation in addition to that received for their services as [officers](/usc/10/101.md?p=b-1) or employees of the [United States](/usc/10/101.md?p=a-1).
  - (2) The members of the board shall be allowed travel expenses, including per diem in lieu of subsistence, at [rates](/usc/10/101.md?p=b-9) authorized for employees of [agencies](/usc/10/3451.md?p=3) under subchapter I of [chapter 57](/usc/5/chptIII/sptD/ch57.md) of title 5, while away from their homes or [regular](/usc/10/101.md?p=b-12) places of business in the performance of services for the board.
