# §14702. Retention on reserve active-status list of certain officers in the grade of major, lieutenant colonel, colonel, or brigadier general

- (a) **Retention.—** Notwithstanding the provisions of section [14506](/usc/10/14506.md), [14507](/usc/10/14507.md), or [14508](/usc/10/14508.md) of this title, the [Secretary](/usc/10/12521.md?p=4) of the military [department](/usc/10/12521.md?p=5) concerned may, with the [officer](/usc/10/101.md?p=b-1)’s consent, retain on the [reserve active-status list](/usc/10/101.md?p=c-7) an [officer](/usc/10/101.md?p=b-1) in the [grade](/usc/10/101.md?p=b-7) of major, lieutenant colonel, colonel, or brigadier general who is—
  - (1) an [officer](/usc/10/101.md?p=b-1) of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) and assigned to a headquarters or headquarters detachment of a [State](/usc/10/18232.md?p=1); or
  - (2) a [reserve](/usc/10/101.md?p=c-6) [officer](/usc/10/101.md?p=b-1) of the Army or Air Force who, as a condition of continued employment as a [National Guard](/usc/10/101.md?p=c-1) or [Reserve](/usc/10/101.md?p=c-6) technician is required by the [Secretary concerned](/usc/10/101.md?p=a-9) to maintain membership in a Selected [Reserve](/usc/10/101.md?p=c-6) unit or organization.
- (b) **Separation for Age.—** An [officer](/usc/10/101.md?p=b-1) may be retained under this section only so long as the [officer](/usc/10/101.md?p=b-1) continues to meet the conditions of paragraph [(1)](#a-1) or [(2)](#a-2) of subsection (a). An [officer](/usc/10/101.md?p=b-1) described in [paragraph (1)](#a-1) of such subsection may not be retained under this section after the last day of the month in which the [officer](/usc/10/101.md?p=b-1) becomes 62 years of age. An [officer](/usc/10/101.md?p=b-1) described in [paragraph (2)](#a-2) of such subsection may not be retained under this section after the last day of the month in which the [officer](/usc/10/101.md?p=b-1) becomes 62 years of age.
