# §12244. Warrant officers: discharge or retirement for years of service or for age


Each [reserve](/usc/10/101.md?p=c-6) [warrant officer](/usc/10/101.md?p=b-3) of the Army, Navy, Air Force, or Marine Corps who is in an [active status](/usc/10/101.md?p=d-4) and has reached the maximum years of service or age prescribed by the [Secretary concerned](/usc/10/101.md?p=a-9) shall—

- (1) be transferred to the Retired [Reserve](/usc/10/101.md?p=c-6) if the [warrant officer](/usc/10/101.md?p=b-3) is qualified for such transfer and does not request (in accordance with regulations prescribed by the [Secretary concerned](/usc/10/101.md?p=a-9)) not to be transferred to the Retired [Reserve](/usc/10/101.md?p=c-6); or
- (2) be discharged if the [warrant officer](/usc/10/101.md?p=b-3) is not qualified for transfer to the Retired [Reserve](/usc/10/101.md?p=c-6) or has requested (in accordance with regulations prescribed by the [Secretary concerned](/usc/10/101.md?p=a-9)) not to be so transferred.
