# §1214. Right to full and fair hearing


No member of the [armed forces](/usc/10/101.md?p=a-4) may be retired or separated for physical disability without a full and fair hearing if the member demands it. The [Secretary concerned](/usc/10/2801.md?p=c-5) may require submission of a statement of contention as part of the demand.
