# §1104. Sharing of health-care resources with the Department of Veterans Affairs

- (a) **Sharing of Health-Care Resources.—** Health-care resources of the [Department](/usc/10/101.md?p=a-6) of Defense shall be shared with health-care resources of the Department of Veterans Affairs in accordance with [section 8111 of title 38](/usc/38/8111.md) or under [section 1535 of title 31](/usc/31/1535.md).
- (b) **Reimbursement From CHAMPUS Funds.—** Pursuant to an agreement entered into under [section 8111 of title 38](/usc/38/8111.md) or [section 1535 of title 31](/usc/31/1535.md), the [Secretary](/usc/10/4951.md?p=3) of a [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) may reimburse the [Secretary](/usc/10/4951.md?p=3) of Veterans Affairs from funds available for that [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) for the payment of medical care provided under section [1079](/usc/10/1079.md) or [1086](/usc/10/1086.md) of this title.
- (c) **Charges.—** The [Secretary](/usc/10/4951.md?p=3) of Defense may prescribe by regulation a premium, deductible, copayment, or other charge for [health care](/usc/10/1072.md?p=10) provided to [covered beneficiaries](/usc/10/1072.md?p=5) under this chapter pursuant to an agreement entered into by the [Secretary](/usc/10/4951.md?p=3) of a [military](/usc/10/801.md?p=8) [department](/usc/10/101.md?p=a-6) under [section 8111 of title 38](/usc/38/8111.md) or [section 1535 of title 31](/usc/31/1535.md).
- (d) **Provision of Services During War or National Emergency.—** Members of the [armed forces](/usc/10/101.md?p=a-4) on [active duty](/usc/10/101.md?p=d-1) during and immediately following a period of war, or during and immediately following a national emergency involving the use of the [armed forces](/usc/10/101.md?p=a-4) in armed conflict, may be provided health-care services by the Department of Veterans Affairs in accordance with [section 8111A of title 38](/usc/38/8111A.md).
