# §1095e. TRICARE program: beneficiary counseling and assistance coordinators

- (a) **Establishment of Positions.—** The [Secretary](/usc/10/4951.md?p=3) of Defense shall require in regulations that—
  - (1) each lead agent under the [TRICARE program](/usc/10/1072.md?p=7)—
    - (A) designate a [person](/usc/10/2700.md?p=2) to serve full-time as a beneficiary counseling and assistance coordinator for beneficiaries under the [TRICARE program](/usc/10/1072.md?p=7);
    - (B) designate for each of the [TRICARE program](/usc/10/1072.md?p=7) regions at least one [person](/usc/10/2700.md?p=2) (other than a [person](/usc/10/2700.md?p=2) designated under [subparagraph (A)](#a-1-A)) to serve full-time as a beneficiary counseling and assistance coordinator solely for members of the [reserve](/usc/10/101.md?p=c-6) [components](/usc/10/3011.md?p=13) and their [dependents](/usc/10/1072.md?p=2) who are beneficiaries under the [TRICARE program](/usc/10/1072.md?p=7); and
    - (C) provide for toll-free telephone communication between such beneficiaries and the beneficiary counseling and assistance coordinator; and
  - (2) the commander of each [military](/usc/10/801.md?p=8) medical treatment [facility](/usc/10/2700.md?p=2) under this chapter designate a [person](/usc/10/2700.md?p=2) to serve, as a primary or collateral duty, as beneficiary counseling and assistance coordinator for beneficiaries under the [TRICARE program](/usc/10/1072.md?p=7) served at that [facility](/usc/10/2700.md?p=2).
- (b) **Duties.—** The [Secretary](/usc/10/4951.md?p=3) shall prescribe the duties of the position of beneficiary counseling and assistance coordinator in the regulations required by [subsection (a)](#a).
