# §1095d. TRICARE program: waiver of certain deductibles

- (a) **Waiver Authorized.—** The [Secretary](/usc/10/4951.md?p=3) of Defense may waive the deductible payable for medical care provided under the [TRICARE program](/usc/10/1072.md?p=7) to an [eligible dependent](/usc/10/1111.md?p=b-2) of—
  - (1) a member of a [reserve](/usc/10/101.md?p=c-6) [component](/usc/10/3011.md?p=13) on [active duty](/usc/10/101.md?p=d-1) pursuant to a call or order to [active duty for a period of more than 30 days](/usc/10/101.md?p=d-2); or
  - (2) a member of the [National Guard](/usc/10/101.md?p=c-1) on [full-time National Guard duty](/usc/10/101.md?p=d-5) pursuant to a call or order to [full-time National Guard duty](/usc/10/101.md?p=d-5) for a period of more than 30 days.
- (b) **Eligible Dependent.—** As used in this section, the term “[eligible dependent](/usc/10/1111.md?p=b-2)” means a [dependent](/usc/10/1072.md?p=2) described in subparagraph (A), (D), or (I) of [section 1072(2) of this title](/usc/10/1072.md?p=2).
