# §1076f. TRICARE program: extension of coverage for certain members of the National Guard and dependents during certain disaster response duty

- (a) **Extended Coverage.—** During a period in which a member of the [National Guard](/usc/10/101.md?p=c-1) is performing disaster [response](/usc/10/2700.md?p=2) duty, the member may be treated as being on [active duty for a period of more than 30 days](/usc/10/101.md?p=d-2) for purposes of the eligibility of the member and [dependents](/usc/10/1072.md?p=2) of the member for [health care](/usc/10/1072.md?p=10) benefits under the [TRICARE program](/usc/10/1072.md?p=7) if such period immediately follows a period in which the member served on [full-time National Guard duty](/usc/10/101.md?p=d-5) under [section 502(f) of title 32](/usc/32/502.md?p=f), including pursuant to [chapter 9](/usc/10/chstA/ptI/ch9.md) of such title, unless the Governor of the [State](/usc/10/4951.md?p=4) (or, with respect to the District of Columbia, the mayor of the District of Columbia) determines that such extended eligibility is not in the best interest of the member or the [State](/usc/10/4951.md?p=4).
- (b) **Contribution by State.—**
  - (1) The [Secretary](/usc/10/4951.md?p=3) shall charge a [State](/usc/10/4951.md?p=4) for the costs of providing coverage under the [TRICARE program](/usc/10/1072.md?p=7) to members of the [National Guard](/usc/10/101.md?p=c-1) of the [State](/usc/10/4951.md?p=4) and the [dependents](/usc/10/1072.md?p=2) of the members pursuant to [subsection (a)](#a). Such charges shall be paid from the funds of the [State](/usc/10/4951.md?p=4) or from any other non-Federal funds.
  - (2) Any amounts received by the [Secretary](/usc/10/4951.md?p=3) under [paragraph (1)](#b-1) shall be credited to the appropriation available for the Defense Health [Program](/usc/10/2101.md?p=1) Account under [section 1100 of this title](/usc/10/1100.md), shall be merged with sums in such Account that are available for the fiscal year in which collected, and shall be available under [subsection (b)](/usc/10/1100.md?p=b) of such section, including to carry out [subsection (a)](#a) of this section.
- (c) **Definitions.—** In this section:
  - (1) The term “disaster [response](/usc/10/2700.md?p=2) duty” means duty performed by a member of the [National Guard](/usc/10/101.md?p=c-1) in [State](/usc/10/4951.md?p=4) status pursuant to an emergency declaration by the Governor of the [State](/usc/10/4951.md?p=4) (or, with respect to the District of Columbia, the mayor of the District of Columbia) in [response](/usc/10/2700.md?p=2) to a disaster or in preparation for an imminent disaster.
  - (2) The term “[State](/usc/10/4951.md?p=4)” means each of the several [States](/usc/10/4951.md?p=4), the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the [United States](/usc/10/101.md?p=a-1).
