# §1061. Survivors of certain Reserve and Guard members

- (a) **Benefits.—** The [Secretary](/usc/10/4951.md?p=3) of Defense shall prescribe regulations to allow [dependents](/usc/10/1072.md?p=2) of members of the [uniformed services](/usc/10/1072.md?p=1) described in [subsection (b)](#b) to use commissary and exchange stores on the same basis as [dependents](/usc/10/1072.md?p=2) of members of the [uniformed services](/usc/10/1072.md?p=1) who die while on [active duty for a period of more than 30 days](/usc/10/101.md?p=d-2).
- (b) **Covered Dependents.—** A [dependent](/usc/10/1072.md?p=2) referred to in [subsection (a)](#a) is a [dependent](/usc/10/1072.md?p=2) of a member of a uniformed service who died—
  - (1) while on [active duty](/usc/10/101.md?p=d-1), [active duty](/usc/10/101.md?p=d-1) for [training](/usc/10/301.md?p=9), or [inactive-duty training](/usc/10/101.md?p=d-7) (regardless of the period of such duty); or
  - (2) while traveling to or from the place at which the member was to perform, or has performed, [active duty](/usc/10/101.md?p=d-1), [active duty](/usc/10/101.md?p=d-1) for [training](/usc/10/301.md?p=9), or [inactive-duty training](/usc/10/101.md?p=d-7) (regardless of the period of such duty).
