# §10215. Officers of Army National Guard of the United States and Air National Guard of the United States: authority with respect to Federal status

- (a)
  - (1) [Officers](/usc/10/101.md?p=b-1) of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) who are not on [active duty](/usc/10/101.md?p=d-1)—
    - (A) may order members of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) to [active duty](/usc/10/101.md?p=d-1) for training under [section 12301(d) of this title](/usc/10/12301.md?p=d); and
    - (B) with the approval of the [Secretary](/usc/10/12521.md?p=4) of the Air Force, may order members of the [Air National Guard of the United States](/usc/10/101.md?p=c-5) to [active duty](/usc/10/101.md?p=d-1) for training under that section.
  - (2) [Officers](/usc/10/101.md?p=b-1) of the [Air National Guard of the United States](/usc/10/101.md?p=c-5) who are not on [active duty](/usc/10/101.md?p=d-1)—
    - (A) may order members of the [Air National Guard of the United States](/usc/10/101.md?p=c-5) to [active duty](/usc/10/101.md?p=d-1) for training under [section 12301(d) of this title](/usc/10/12301.md?p=d); and
    - (B) with the approval of the [Secretary](/usc/10/12521.md?p=4) of the Army, may order members of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) to [active duty](/usc/10/101.md?p=d-1) for training under that section.
- (b) [Officers](/usc/10/101.md?p=b-1) of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) or the [Air National Guard of the United States](/usc/10/101.md?p=c-5) who are not on [active duty](/usc/10/101.md?p=d-1)—
  - (1) may enlist, reenlist, or extend the enlistments of persons as [Reserves](/usc/10/101.md?p=c-6) of the Army or [Reserves](/usc/10/101.md?p=c-6) of the Air Force for service in the [Army National Guard of the United States](/usc/10/101.md?p=c-3) or the [Air National Guard of the United States](/usc/10/101.md?p=c-5), as the case may be; and
  - (2) with respect to their Federal status, may promote or discharge persons enlisted or reenlisted as [Reserves](/usc/10/101.md?p=c-6) of the Army or [Reserves](/usc/10/101.md?p=c-6) of the Air Force for that service.
- (c) This section shall be carried out under regulations prescribed by the [Secretary](/usc/10/12521.md?p=4) of the Army, with respect to matters concerning the Army, and by the [Secretary](/usc/10/12521.md?p=4) of the Air Force, with respect to matters concerning the Air Force.
