# §10146. Ready Reserve: transfer from

- (a) Subject to [subsection (c)](#c) and under regulations prescribed by the [Secretary](/usc/10/12521.md?p=4) of Defense, or by the [Secretary](/usc/10/12521.md?p=4) of Homeland Security with respect to the Coast Guard when it is not operating as a service in the Navy, a member in the Ready [Reserve](/usc/10/101.md?p=c-6) may be transferred to the Standby [Reserve](/usc/10/101.md?p=c-6).
- (b) A [Reserve](/usc/10/101.md?p=c-6) who is qualified and so requests may be transferred to the Retired [Reserve](/usc/10/101.md?p=c-6) under regulations prescribed by the [Secretary concerned](/usc/10/101.md?p=a-9) and, in the case of the [Secretary](/usc/10/12521.md?p=4) of a military [department](/usc/10/12521.md?p=5), approved by the [Secretary](/usc/10/12521.md?p=4) of Defense.
- (c) A member of the [Army National Guard of the United States](/usc/10/101.md?p=c-3) or the [Air National Guard of the United States](/usc/10/101.md?p=c-5) may be transferred to the Standby [Reserve](/usc/10/101.md?p=c-6) only with the consent of the governor or other appropriate authority of the [State](/usc/10/18232.md?p=1).
