# §590.50. Egg temperature and labeling requirements.

- (a) All shell eggs packed into containers destined for the ultimate consumer must be stored and transported under refrigeration at an ambient temperature of no greater than 45 °F (7.2 °C) and must bear safe handling instructions in accordance with [21 CFR 101.17(h)](/cfr/21/101.17.md?p=h).
- (b) Any producer-packer with an annual egg production from a flock of 3,000 or fewer layers is exempt from the temperature and labeling requirements of this section. Such producer-packer is still required to comply with the labeling requirements in [21 CFR 101.17(h)](/cfr/21/101.17.md?p=h).
