# §246.3. Allegations contested or denied; hearing requested.


If, within the prescribed time following service of the notice pursuant to [§ 246.1](/cfr/8/246.1.md), the respondent has filed an answer which contests or denies any allegation in the notice, or a hearing is requested, a hearing pursuant to [§ 246.5](/cfr/8/246.5.md) shall be conducted by an immigration judge, and the requirements contained in §§ [240.3](/cfr/8/240.3.md), [240.4](/cfr/8/240.4.md), [240.5](/cfr/8/240.5.md), [240.6](/cfr/8/240.6.md), [240.7](/cfr/8/240.7.md), and [240.9](/cfr/8/240.9.md) of this chapter shall be followed.
