# §1280.1. Review of fines and civil monetary penalties imposed by DHS.

- (a) **Applicable regulations.** The regulations of the Department of Homeland Security (DHS) relating to the imposition of certain fines and civil monetary penalties under provisions of the Immigration and Nationality Act, including sections [231(g)](/cfr/8/231.md?p=g), [234](/cfr/8/234.md), [240B(d)](/cfr/8/240B.md?p=d), [241(d)](/cfr/8/241.md?p=d) and [(e)](/cfr/8/241.md?p=e), [243(c)(1)](/cfr/8/243.md?p=c-1), [251(d)](/cfr/8/251.md?p=d), [254(a)](/cfr/8/254.md?p=a), [255](/cfr/8/255.md), [256](/cfr/8/256.md), [257](/cfr/8/257.md), [271(a)](/cfr/8/271.md?p=a), [272(a)](/cfr/8/272.md?p=a), [273(b)](/cfr/8/273.md?p=b), [274D](/cfr/8/274D.md), and [275(b)](/cfr/8/275.md?p=b), are contained in [8 CFR part 280](/cfr/8/part280.md).
- (b) **Adjudication of civil monetary penalty proceedings.** The Board of Immigration Appeals (Board) has appellate authority to review DHS decisions involving fines and civil monetary penalties imposed under [8 CFR part 280](/cfr/8/part280.md), as provided under [8 CFR part 1003](/cfr/8/part1003.md), except that the Board shall have no authority to review any decision imposing a civil monetary penalty under sections 240B(d), 274D(a)(1), or 275(b) of the Act unless the conditions described in [8 CFR 281.1(h)](/cfr/8/281.1.md?p=h) are met. The regulations in [8 CFR part 280](/cfr/8/part280.md) governing the imposition of certain fines and civil monetary penalties are applicable in such proceedings before the Board.
- (c) **Civil monetary penalties under sections 274A, 274B, or 274C.** For regulations relating to civil monetary penalties imposed under sections 274A, 274B, or 274C of the Act, see 8 CFR parts [274a](/cfr/8/part274a.md) and [1274a](/cfr/8/part1274a.md) and [28 CFR part 68](/cfr/28/part68.md).
