# §760.2003. Eligible producers.

- (a) The eligibility provisions applicable to LFP apply to ELRP 2023 and 2024, excluding the average AGI limitation. These include the provisions of: [7 CFR part 1416](/cfr/7/part1416.md), subparts [A](/cfr/7/subpartA.md) and [C](/cfr/7/subpartC.md); [7 CFR part 12](/cfr/7/part12.md); and [7 CFR 718.6](/cfr/7/718.6.md).
- (b) To be eligible for a payment under this subpart, a producer must have an approved LFP application on file for the 2023 or 2024 program year. Producers may receive payment for one or both years, if eligible.
- (c) States, political subdivisions, and agencies thereof, are not eligible for payments under this subpart.
