# §760.1703. Eligible affected farmers.

- (a) To be eligible, an affected farmer, the farmer must be a:
  - (1) Citizen of the United States;
  - (2) Resident alien, which for purposes of this subpart means “lawful alien” as defined in [7 CFR 1400.3](/cfr/7/1400.3.md);
  - (3) Partnership organized under state law consisting solely of citizens of the United States or resident aliens;
  - (4) Corporation, limited liability company, or other organizational structure organized under State law consisting solely of citizens of the United States or resident aliens; or
  - (5) Indian Tribe or Tribal organization, as defined in [section 4(b)](/cfr/7/4.md?p=b) of the Indian Self-Determination and Education Assistance Act ([25 U.S.C. 5304](/usc/25/5304.md)).
- (b) In addition to the requirements in [paragraph (a)](#a) of this section, to be eligible, an affected farmer must comply with all provisions of this subpart and, as applicable:
  - (1) [7 CFR part 12](/cfr/7/part12.md)—Highly Erodible Land and Wetland Conservation;
  - (2) [7 CFR part 707](/cfr/7/part707.md)—Payments Due Persons Who Have Died, Disappeared, or Have Been Declared Incompetent;
  - (3) [7 CFR part 718](/cfr/7/part718.md)—Provisions Applicable to Multiple Programs; and
  - (4) [7 CFR part 1403](/cfr/7/part1403.md)—Debt Settlement Policies and Procedures.
