# §1.314. Parties to the hearing.

- (a) The parties to the hearing shall be the respondent and USDA. The proceeding shall be brought in the name of the Secretary.
- (b) Pursuant to [31 U.S.C. 3730(c)(5)](/usc/31/3730.md?p=c-5), a private party plaintiff under the False Claims Act may participate in proceedings under this subpart to the extent authorized by the provisions of that Act.
