# §218.153. Prohibitions.

- (a) Except for incidental takings contemplated in [§ 218.152(a)](/cfr/50/218.152.md?p=a) and authorized by an LOA issued under [§§ 216.106](/cfr/50/216.106.md) of this chapter and 218.156, it shall be unlawful for any person to do any of the following in connection with the activities listed in [§ 218.150(c)](/cfr/50/218.150.md?p=c):
  - (1) Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or an LOA issued under [§§ 216.106](/cfr/50/216.106.md) of this chapter and 218.156;
  - (2) Take any marine mammal not specified in [§ 218.152(b)](/cfr/50/218.152.md?p=b);
  - (3) Take any marine mammal specified in [§ 218.152(b)](/cfr/50/218.152.md?p=b) in any manner other than as specified in the LOA; or
  - (4) Take a marine mammal specified in [§ 218.152(b)](/cfr/50/218.152.md?p=b) if the National Marine Fisheries Service (NMFS) determines such taking results in more than a negligible impact on the species or stocks of such marine mammal.
