# §218.143. Prohibitions.

- (a) Notwithstanding incidental takings contemplated in [§ 218.142(a)](/cfr/50/218.142.md?p=a) and authorized by LOAs issued under [§§ 216.106](/cfr/50/216.106.md) of this chapter and 218.146, no person in connection with the activities listed in [§ 218.140(c)](/cfr/50/218.140.md?p=c) may:
  - (1) Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or an LOA issued under [§§ 216.106](/cfr/50/216.106.md) of this chapter and 218.146;
  - (2) Take any marine mammal not specified in [§ 218.142(b)](/cfr/50/218.142.md?p=b);
  - (3) Take any marine mammal specified in [§ 218.142(b)](/cfr/50/218.142.md?p=b) in any manner other than as specified in the LOAs; or
  - (4) Take a marine mammal specified in [§ 218.142(b)](/cfr/50/218.142.md?p=b) if NMFS determines such taking results in more than a negligible impact on the species or stock of such marine mammal.
