# §217.92. Permissible methods of taking.


Under a LOA issued pursuant to [§§ 216.106](/cfr/50/216.106.md) of this chapter and 217.96, the holder of the LOA (hereinafter “TPWD”) may incidentally, but not intentionally, take marine mammals within the areas described in [§ 217.90](/cfr/50/217.90.md) by Level A harassment, serious injury, or mortality associated with fisheries research provided the activity is in compliance with all terms, conditions, and requirements of the regulations in this subpart and the relevant LOA.
