# §217.62. Permissible methods of taking.

- (a) Under an LOA issued pursuant to [§ 216.106](/cfr/50/216.106.md) of this chapter and [§ 217.66](/cfr/50/217.66.md) or [§ 217.67](/cfr/50/217.67.md), the Holder (hereinafter the USSF) may incidentally, but not intentionally, take marine mammals by Level B harassment, as described in § [217.60(a)](/cfr/50/217.60.md?p=a) and [(b)](/cfr/50/217.60.md?p=b), provided the activity is in compliance with all terms, conditions, and requirements of the regulations in this subpart and the appropriate LOA.
- (b) The incidental take of marine mammals by the activities listed in [§ 217.60](/cfr/50/217.60.md) is limited to the following species and stocks:
